It is my opinion that the SCOTUS will attempt to nullify the 14th Amendment on a 6-3 split decision.
Three propositions before the Court:
1. That Trump is an insurrectionist.
2. That no insurrectionists may be on the ballot.
3. Therefore Trump may not be on the ballot.
The Court may deny #1, and defy the facts; or it may deny #2, and defy the Constitution; or it may deny #3, and defy logic.
@Paradoctor, is Supreme Court going to try a criminal case of Trump as well? I am kind of confused. To summarize what I know:
1. Trump saying president has immunity, seems to have a constitution ruling, so supreme court can rule on it. And I expect they will rule that president is not immune. (most likely 9-0)
2. 14th Amendment, does officer/president comes under it? I think this will also be against trump (7-2 or 6-3)
3. Has Trump committed crime of insurrection? Who is ruling on that?
The lower Colorado court did a trial on whether or not Trump committed insurrection. They concluded yes.
All you have to do is imagine how Republicans would be reacting if Biden had lost and then spouted off about a rigged election for weeks on end, despite dozens of lost legal challenges, and then spurred on his rabid mob on J6, like Trump. Case closed.
The comic makers are going to have fun with Trump’s speech in New Hampshire Saturday where Nikki Haley is to blame for not stopping the inssurection.
